Thank you for your interest in training with us! Please read below for a summary of our policies, terms and conditions that apply to our clients. POLICIES, TERMS AND CONDITIONS This website is owned and operated by Two Nine Fitness LLC. The following sets forth our policies, terms and conditions (the “terms”) under which you may use our website and services offered by us. This website offers coaching services in the form of subscriptions for Personal Training, Personal Programming, and Group Training. If you (the “client”) purchase a subscription for coaching services with Two Nine Fitness LLC (“Two Nine Fitness”) you agree to the following: CLIENT POLICY: Two Nine Fitness does not work with clients under the age of 18, in active treatment of an eating disorder, or pregnant. It is the client’s responsibility to disclose such information and note before purchase. If the client becomes pregnant, it is the client’s responsibility to cancel their training in accordance with the Cancellation Policy. PAYMENT POLICY: Client payment will be automatically processed on a monthly basis on or about the date of the initial purchase date until client cancels the subscription. The client will be promptly contacted if there is an issue with their payment. All payment will occur between the client and Two Nine Fitness LLC. All training subscriptions are in USD. REFUND POLICY: Refunds will not be issued for partially unused training subscriptions or due to failure by the client to cancel in a timely fashion. Other circumstances may be considered on a case-by-case basis. CANCELLATION POLICY: Subscriptions may be cancelled through the client's account on the website. Once cancelled, client will not have access to their plan and its benefits after the current billing cycle ends. Two Nine Fitness does not issue refunds for training subscriptions that are not cancelled prior to the next billing date. ACCEPTABLE USE POLICY: Training programs provided in Personal Training and Personal Programming are individualized for each client. As such, training programs are not to be shared or distributed to other people. Only the client will have access to their training profile within the TruCoach app or their training program and should not share login information or documents with others. Access to the training app and training program will discontinue after the client has ended their coaching subscription. INTELLECTUAL PROPERTY UNDERSTANDING: All training programs, website content, coaching guidance and video content (with the exception of TruCoach stock content) are the sole intellectual property of Two Nine Fitness. As such, they are not to be shared or distributed to anyone other than the client. The client is permitted to share, on social media, photos or videos of their workouts, comments on knowledge gained, or insight into the client training experience as long as such content is attributed to Two Nine Fitness (i.e., by tagging Two Nine Fitness or its representative). SUSPENSION OF CLIENT ACCOUNT: We may permanently or temporarily terminate or suspend client access without notice and liability for any reason, including if in our sole determination client violates any provision of these Policies, Terms and Conditions or any applicable law or regulations. MEDICAL DISCLOSURE: The client is solely responsible to disclose any prior or ongoing medical illnesses, injuries, or diagnoses that will or may impact their ability to exercise. It is the client’s responsibility to gain medical clearance for any issues or conditions that require medical consultation prior to starting or continuing training with Two Nine Fitness. CHANGES IN COACHING SERVICES OFFERED: We may, without prior notice, make changes to the coaching services offered; stop providing the services, alter features of the services; or create limits for the services. CHANGES AND MODIFICATION OF POLICIES, TERMS AND CONDITIONS: We reserve the right to modify our policies, terms and conditions (“terms”) from time to time at our sole discretion. As such, clients are advised to review these pages periodically. When we change the terms in a material manner, we will notify clients that material changes have been made. Client’s continued use of the website or our service after any such change constitutes client’s acceptance of the new terms. If you do not agree to any of these terms or any future version of the terms, do not use or access (or continue to access) the website or the service.
